Proposed legislation: Protecting professionals’ freedom
If passed, the Regulated Professions Neutrality Act would set clear limits on when regulators can discipline professionals for off-duty expressive conduct.
Regulators would not be allowed to require training that is not related to competence or professional ethics. The proposed act would also prevent unfair treatment or judgment by regulators based on personal characteristics or beliefs.
The legislation also aims to establish a clear standard for courts reviewing regulator decisions that are governed by the Regulated Professions Neutrality Act, or involve rights under the Canadian Charter of Rights and Freedoms and the Alberta Bill of Rights.
